It is time for my tenancy renewal and my landlord wants to increase the rent. Can he legally increase the price?

Per Dubai Law 43 of 2013 Article 1, the maximum percentage of rent increase for real property in the Emirate of Dubai will be as follows:

When renewing real property lease contracts:

  1. No rent increase, where the rent of the real property unit is up to ten percent (10%) less than the average rental value of similar units;
  2.  5% increase of the rent of the real property unit – Where the rent is 11% to 20% less than the average rental value of similar units;
  3. 10% of the rent of the real property unit –  Where the rent is 21% to 30% less than the average rental value of similar units;
  4. 15% of the rent of the real property unit – Where the rent is 31% to 40% less than the average rental value of similar units; or
  5.  20% of the rent of the real property unit – Where the rent is more than 40% less than the average rental value of similar units.

In addition, the increase must be communicated in writing 90 days prior to the expiry of the contract.  If this is not done, the rent cannot be increased regardless if it is merited via the above law.
